Terms of Service.

These Terms of Service ("Terms") govern your access to and use of the Bamba Wallet platform ("Platform"). By registering an account or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. Eligibility

You must be at least 18 years of age and legally capable of entering into a binding agreement to use the Platform. By using Bamba Wallet, you confirm you meet these requirements.

2. Nature of the Platform

Bamba Wallet is not a bank, and we are currently unregulated. When you deposit money, those funds are held in our business bank account on your behalf and reflected as a balance in your wallet. That balance is not a bank deposit in your name, and it is not covered by any deposit insurance scheme.

You can use your balance to pay a merchant or send money to another Bamba Wallet user at any time, and you can request a withdrawal at any time, subject to the limits and fees set out in Fees & Limits.

3. Account Registration and Approval

Personal accounts are activated once you verify your email address. Merchant accounts, identity verification, deposits and withdrawals are reviewed by our team. We reserve the right to approve or decline any account registration at our sole discretion.

You are responsible for maintaining the confidentiality of your login credentials. You must notify us immediately if you suspect unauthorised access to your account.

4. Acceptable Use

You agree not to use the Platform for:

  • Any unlawful purpose, including money laundering, fraud, or financing of illegal activities
  • Sending funds to or receiving funds from sanctioned individuals or entities
  • Attempting to circumvent identity verification or security measures
  • Providing false or misleading information during registration or at any point of use

5. Transactions

All transaction fees are disclosed before confirmation. By confirming a transaction, you authorise the relevant debit or transfer from your wallet. Transactions that are confirmed and processed may not be reversible.

Wallet-to-wallet transfers between users are free. Merchant accounts are charged 1.5% + R1.00 on each customer payment received; this fee is deducted automatically and is the only cost of accepting payments as a merchant. The minimum payment to a merchant is R5.

We reserve the right to hold, delay, or reverse transactions where there is reason to suspect fraud, policy violation, or regulatory risk.

6. Deposits and Withdrawals

Deposit and withdrawal requests are subject to administrative review. Processing times are not guaranteed and may vary. Withdrawals are subject to available balance and any applicable fees shown at the time of request. Merchant withdrawals are paid in one batch each night after 23:00 (South African time); requests made after 23:00 are paid in the next night's batch.

7. Account Suspension and Termination

We may suspend or terminate your account at any time if we believe you have violated these Terms, engaged in fraudulent activity, or if required by law. Where permitted, we will notify you of the reason for suspension or termination.

You may close your account at any time by contacting support. Outstanding balances will be handled in accordance with applicable regulations.

8. Limitation of Liability

To the maximum extent permitted by law, Bamba Wallet shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, including loss of funds resulting from user error, unauthorised access obtained through no fault of ours, or third-party actions.

9. Indemnification

You agree to indemnify and hold harmless Bamba Wallet and its administrators from any claims, losses, or damages arising from your violation of these Terms or misuse of the Platform.

10. Changes to Terms

We may update these Terms from time to time. Continued use of the Platform after changes take effect constitutes your acceptance of the revised Terms. We will provide notice of material changes via email or an in-platform notification.

11. Governing Law

These Terms are governed by applicable law. Any disputes shall be resolved in the competent courts of the jurisdiction in which Bamba Wallet operates.
